Nagen, operated by NAGEN BTB LTD (“we”, “our”, or “the app”), is a music discovery app that helps you explore the stories behind your favorite songs. This Privacy Policy explains what data we collect, how we use it, and your rights.

1. Data We Collect

We collect the following categories of data:

• Account information: Email address and display name when you sign up via email or Google Sign-In.
• Listening history: Song titles, artist names, and album art for songs you identify or search for within the app.
• Preferences: Your chosen language, notification settings, and theme preferences.
• Usage activity: Number of stories read, sessions count, and gamification stats (XP, level) to personalize your experience.
• Audio recordings: Temporary microphone audio used solely for song recognition. Audio is sent to our server for processing and is never stored.
• Push notification tokens: Device tokens for delivering notifications, stored only while notifications are enabled.

2. How We Use Your Data

• To provide song recognition and story generation services.
• To sync your listening history and preferences across devices.
• To personalize your experience with music preference insights.
• To send push notifications about new features or your recognized songs (with your permission).
• To enforce usage limits and prevent abuse.

3. Legal Basis for Processing (EEA/UK Users)

Under the General Data Protection Regulation (GDPR), we process your data on the following legal bases:

• Consent: For push notifications, microphone access, and optional analytics.
• Contract performance: To provide core app features including authentication, story generation, and history sync.
• Legitimate interest: For abuse prevention, usage limits enforcement, and service improvement.

You may withdraw your consent at any time by disabling the relevant feature (e.g., notifications) or by deleting your account.

4. Third-Party Services

We use the following third-party services to operate the app:

• Firebase (Google): Authentication, cloud database, and serverless functions. Data is stored on Google Cloud servers and processed under the Google Cloud Data Processing Terms.
• ACRCloud: Audio fingerprinting for song recognition. Audio is processed in real time and not retained.
• Spotify: Music metadata (song info, album art, previews). We do not share your personal data with Spotify.
• Google Gemini AI: Story generation. Song titles and artist names are sent to generate stories. No account information, email addresses, or other personally identifiable data is included in these requests. Google processes this data under the Google Cloud Data Processing Terms.
• Tavily: Web search for gathering factual information about songs. Only song titles and artist names are sent. No personal user data is shared.
• Firebase Analytics (Google): Anonymous, aggregate product analytics to understand how features are used. No advertising IDs or cross-app tracking. Data is processed by Google under Firebase terms.

5. AI-Generated Content

Song stories in this app are generated using artificial intelligence (Google Gemini). The AI synthesizes information from web sources to create narratives about songs. AI-generated content may not always be perfectly accurate. We clearly label AI-generated stories within the app.

6. Data Security

• All data is transmitted over HTTPS (encrypted in transit).
• API credentials are stored server-side and never exposed to the client app.
• Firebase App Check validates that requests come from genuine app installations.
• Firestore security rules ensure you can only access your own data.

7. Data Retention & Account Deletion

Your data is retained for as long as your account is active. Audio recordings are never stored; they are processed in real time and immediately discarded. You can delete individual songs from your history at any time.

When you delete your account, all personal data — including your email, display name, listening history, preferences, and usage statistics — is permanently deleted from our servers within 30 days. Some data may be retained in encrypted backups for up to 90 days before automatic purging.

8. Your Rights

All users have the following rights:

• Access: View your data anytime in the Profile section of the app.
• Rectification: Update your display name and email from the Profile screen. For other corrections, contact us at operation@nagen.app.
• Deletion: Delete your entire account and all associated data from the Profile screen. This is permanent and irreversible.
• Data Portability: You may request a copy of your personal data in a structured, machine-readable format by contacting operation@nagen.app.
• Withdraw Consent: You may withdraw consent for data processing at any time by deleting your account or disabling specific features (e.g., notifications). Withdrawal does not affect the lawfulness of processing before withdrawal.
• History management: Remove individual songs from your listening history.
• Notifications: Disable push notifications at any time from the app settings or your device settings.

9. California Residents (CCPA/CPRA)

If you are a California resident, you have the following additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):

• Right to Know: You may request details about the categories and specific pieces of personal information we collect, the purposes for collection, and which third parties receive it.
• Right to Delete: You may request deletion of your personal information, subject to certain exceptions.
• Right to Opt Out: We do not sell or share your personal information for cross-context behavioral advertising.
• Non-Discrimination: You will not be discriminated against for exercising your privacy rights.

10. International Data Transfers

Your data may be transferred to and processed in the United States and other countries where Google operates its cloud infrastructure. These transfers are protected by Standard Contractual Clauses and compliance with applicable data protection frameworks including the EU-U.S. Data Privacy Framework.

11. Data Breach Notification

In the event of a data breach that poses a risk to your rights and freedoms, we will notify affected users within 72 hours as required by applicable law, and report the breach to the relevant supervisory authority.

12. Tracking & Analytics

We use Firebase Analytics to collect anonymous, aggregate usage data such as which features are used, session counts, and general engagement patterns. This helps us improve the app experience. Firebase Analytics does not use advertising identifiers and does not track you across other apps or websites. We do not use cookies, advertising SDKs, or cross-app tracking technologies. We do not collect advertising identifiers (IDFA/GAID) and we do not engage in device fingerprinting. Per-user usage data (XP, level, stories read) is stored in your own account for personalization purposes.

13. Children’s Privacy

Nagen is not directed at children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected data from a child under 13, we will delete it promptly.

14. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes through the app or via push notification. Continued use of the app after changes constitutes acceptance of the updated policy.

15. Governing Law

This Privacy Policy is governed by the laws of Israel. NAGEN BTB LTD is a company registered in Israel. For EU/EEA residents, you have the right to lodge a complaint with your local data protection supervisory authority.

Welcome to Nagen. By using this app, you agree to these Terms of Service. If you do not agree, please do not use the app.

1. Description of Service

Nagen is a music discovery app that identifies songs and generates AI-powered stories about the music you love. The service includes song recognition, story generation, listening history, and music insights.

2. Account & Eligibility

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the security of your account credentials.
• You may use the app as a guest without creating an account, with limited functionality.
• You can delete your account and all associated data at any time from the Profile screen.

3. AI-Generated Content

Song stories are generated by artificial intelligence using publicly available information. This content is provided for entertainment and educational purposes.

• AI-generated stories may contain inaccuracies or errors.
• Stories are synthesized from web sources and do not represent original reporting or verified facts.
• We label AI-generated content within the app for transparency.
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content.

4. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose.
• Attempt to circumvent usage limits or security measures.
• Reverse engineer, decompile, or tamper with the app.
• Use automated systems to access the service (bots, scrapers).
• Redistribute AI-generated stories as factual journalism or reporting.

5. Intellectual Property

• The Nagen app, its design, and branding are the intellectual property of NAGEN BTB LTD.
• Song metadata (titles, artist names, album art) is provided by third-party services and belongs to their respective rights holders.
• AI-generated stories are created for your personal use within the app.

6. Usage Limits

To ensure fair use and service quality, story generation is subject to daily usage limits. These limits may be adjusted at our discretion.

7. Service Availability

We strive to keep the app available at all times but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time without prior notice.

8. Limitation of Liability

Nagen is provided “as is” without warranties of any kind. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app.

9. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the app after changes constitutes acceptance of the updated terms. We will notify you of significant changes through the app.
